Nurturehood Terms & Conditions

1. About these Terms

These Terms & Conditions apply to services provided by Nurturehood. Nurturehood NZ is a trading name of Kata Varga, who is the person providing the services and the person you are contracting with. References to Nurturehood in these Terms & Conditions are references to her.

By booking and paying for a Nurturehood service, you agree to these Terms & Conditions.

Nurturehood may update these Terms & Conditions from time to time. The version in effect at the time of your booking will apply to that service.

2. The Nurturehood service

Nurturehood provides 1:1 Nurtured Sleep Support for families with babies and young children from birth to 3 years.

The service includes:
• A detailed pre-consultation intake
• An individual consultation of up to 90 minutes
• A personalised written sleep plan
• Two weeks of email support related to your personalised plan

The aim of the service is to provide gentle, responsive and individualised sleep support informed by infant development, neuroscience, attachment and the circumstances of your family.

3. Booking and payment

Full payment is required before your consultation.

Payment is processed through the payment method provided at the time of booking.

Nurturehood does not currently offer payment plans.

A booking is confirmed once payment has been received and the appointment has been scheduled.

4. Consultations

Consultations are provided at the time and through the method agreed at the time of booking.

The consultation is an opportunity to explore your child's sleep and circumstances, discuss your concerns and goals, and consider approaches that may be appropriate for your family.

Nurturehood does not guarantee a particular sleep outcome, change in sleep behaviour or timeframe. Sleep is influenced by many developmental, biological, environmental and family factors, and outcomes will vary between children and families.

5. Personalised sleep plan and email support

Following your consultation, Nurturehood will provide a personalised written sleep plan based on the information you have provided and the discussion during your consultation.

Your package includes two weeks of email support related to your personalised plan.

Nurturehood aims to respond to emails within 24 hours.

The email support is intended to help you understand, implement and adapt the recommendations in your personalised plan. It does not constitute a new consultation or ongoing support beyond the included two-week period.

6. Cancellation and rescheduling

If you need to cancel your appointment:

•24 hours or more before the scheduled appointment: you will receive a full refund.

•Less than 24 hours before the scheduled appointment, or if you do not attend: your payment is not refunded, because the time has been set aside for you and can rarely be filled at short notice. Nurturehood will instead offer you one rescheduled consultation, or a phone consultation if you would prefer that, at no further charge and at a time you and Nurturehood agree. Your personalised written sleep plan and two weeks of email support follow that consultation in the usual way.

Requests outside this policy, including exceptional circumstances, will be considered on a case-by-case basis.

The above applies where you cancel for your own reasons. It does not apply, and does not limit anything you are entitled to, where you cancel because Nurturehood's service has become unavailable.

If Nurturehood needs to cancel or reschedule an appointment, you will be offered the option to reschedule at a mutually convenient time or receive a full refund of any payment made for the affected appointment. Nurturehood will provide as much notice as reasonably possible where a change is necessary.

7. Nature and scope of the service

Nurturehood provides information, education and personalised sleep support. Nurturehood is not a medical service and does not provide medical diagnosis or treatment.

The information and recommendations provided are based on the information you choose to share, the consultation discussion and Nurturehood's professional knowledge and approach.

Nurturehood does not guarantee that a particular approach or recommendation will be suitable for every child or family.

8. Professional referrals

Where appropriate, Nurturehood may recommend that you seek advice from your GP, paediatrician or another suitably qualified health professional.

Where a referral may be appropriate, Nurturehood may recommend a professional from its professional referral network whose approach and scope of practice are considered appropriate to the circumstances.

Nurturehood does not receive any fee, commission or other benefit for referring you to another professional. If that ever changes, Nurturehood will tell you about it before making the referral.

Any advice or services provided by another health or other professional are outside the scope of Nurturehood's services and are subject to that professional's own terms and responsibilities.

9. Parent and caregiver responsibility

Nurturehood provides information, education and personalised sleep support to help you make informed decisions about your family's circumstances.

You remain responsible for deciding what approaches are appropriate for your child and family and for how recommendations are implemented.

You should seek appropriate professional advice where you have concerns about your child's health, development, wellbeing or safety.

By booking a Nurturehood service you confirm that you are the child's parent or guardian, or are otherwise authorised to give Nurturehood information about them and to make decisions about their care. Where another parent or guardian shares responsibility for your child, you confirm that you are also able to act on their behalf. If that other person's position differs, please tell Nurturehood before your consultation so that you can agree how to proceed.

10. Confidentiality and privacy

Nurturehood will treat information shared during the provision of its services as confidential, subject to applicable legal obligations and the circumstances described in the Nurturehood Privacy Statement.

The Nurturehood Privacy Statement explains what personal information is collected, why it is collected, how it is used and stored, and your rights in relation to that information.

The Privacy Statement is available on the Nurturehood website.

11. Intellectual property

All Nurturehood resources, written materials, templates, worksheets and other content provided as part of the service remain the intellectual property of Nurturehood unless otherwise stated.

Materials provided to you are for your personal use and for use in relation to your own family. They may not be reproduced, distributed, published, sold, commercially used or shared as part of another service without prior written permission from Nurturehood.

This does not prevent you from discussing or sharing information from your personalised plan with people directly involved in caring for your child where reasonably necessary for your family's use of the service.

12. Liability

Nurturehood will provide its services with reasonable care and skill.

Nothing in these Terms & Conditions limits or excludes your rights under the Consumer Guarantees Act 1993, or any other right or remedy that cannot lawfully be excluded, restricted or modified.

Nurturehood is not responsible for a failure of the service that results only from something done or not done by someone other than Nurturehood, including the accuracy and completeness of the information you give Nurturehood and how a recommendation is put into practice, or from a cause outside human control. This does not limit the guarantee that Nurturehood will carry out the service with reasonable care and skill.

Except where the Consumer Guarantees Act 1993 or another New Zealand law gives you a right that cannot be excluded, Nurturehood is not liable for indirect or consequential loss, such as lost income, and Nurturehood's total liability for all claims connected with your booking is limited to the amount you paid for that booking.

13. Urgent and emergency situations

Nurturehood is not an emergency service.

If your child has an urgent health or safety concern, or you believe your child requires immediate medical attention, you should seek appropriate urgent or emergency assistance rather than relying on Nurturehood's services.

Nurturehood's email support is not intended for urgent or emergency communication.

14. Changes to the service

Nurturehood may need to make reasonable changes to its services, appointment arrangements or processes from time to time.

Where a change materially affects a service you have already booked, Nurturehood will communicate with you and, where appropriate, offer a reasonable alternative or refund.

15. Governing law

These Terms & Conditions are governed by the laws of New Zealand.

Any disputes arising in connection with these Terms & Conditions or Nurturehood's services will be subject to the applicable laws and courts of New Zealand.
